In many business disputes, the decisive evidence is in the other side’s hands: mailboxes, customer files, commercial data, accounts. We act to obtain or preserve it before any proceedings, notably through pre-action evidence orders under Article 145 of the French Code of Civil Procedure, sought ex parte or on notice, and through bailiff reports and court-appointed experts.

We oversee execution with the judicial officers, arrange escrow of sensitive data and argue challenges to the orders; we also defend businesses targeted by them. These tools serve unfair competition claims as much as commercial disputes, shareholder conflicts or restrictive practices cases.
